Natural compensation sites: : what the regulations say

Abstract

The paper provides the regulator's view of compensation as a legal and economic object. After recalling the regulatory framework for offsetting and the various methods of implementing offsetting provided for in the texts, the paper attempts to answer certain recurring questions concerning natural offsetting sites and possible methods of anticipating offsetting at the territorial level. In particular, it analyzes the various methods imagined for carrying out anticipated compensation in the territories without going through the natural compensation site system, and provides conclusive elements as to the validity of these approaches with respect to the regulatory framework.
